ARTICLE I

Absolute Retention of the Water Right

The water right belongs to the land and the rancher who holds the title—period. No contract, option, or lease shall ever convey, transfer, encumber, or permanently sever ownership. The fee-simple title remains 100% in your name.

ARTICLE II

Statutory Protection Against Abandonment

Under Montana Code Annotated (MCA 85-2-404 and 85-2-408), temporary leasing for instream flow is explicitly protected by state law against forfeiture. Leaving contracted water instream legally counts as continuous, beneficial use.

ARTICLE III

Operational Sovereignty & Incentives

You retain complete authority over your operation. No outside entity will dictate your stocking rates or crop rotation. If you transition marginal irrigated ground to grass, we offer strictly voluntary, outcome-based financial bonuses.

ARTICLE IV

Zero Out-of-Pocket Expense

Every dollar of engineering, hydrogeological modeling, legal filings, DNRC change application fees, and state compliance is paid entirely by the buyer. You will never take on debt to execute this agreement.

ARTICLE V

Automatic Reversion Without Penalty

When the lease term expires, your water immediately and automatically reverts to full agricultural irrigation on your original acreage without needing to re-adjudicate or re-prove your right to the state.

ARTICLE VI

Protection from Corporate Surveillance

The only monitoring on your land is what we mutually agree to upfront in writing. We do not allow out-of-state corporations, surprise environmental audits, or federal agents free rein to set foot on your private property.

Article VII

Absolute Financial Transparency

You receive a guaranteed, fixed annual lease payment per acre-foot for every drop committed, paid on schedule regardless of weather or corporate market fluctuations. If the buyer defaults, the water reverts to your exclusive control immediately.

We cover 100% of the engineering and legal fees to temporarily change the use through the Montana DNRC.

You receive a guaranteed annual premium for your water, and automatically resume full pumping when the term ends.
